GALENA — An Oklahoma man is charged with rape in an incident that occurred in 2004.
Robert Duane Myers, 62, of Muskogee, Okla., formerly of Lampe, was arrested Dec. 20.
According to court documents, a woman discovered a videotape of Myers sexually assaulting her — which happened sometime in late 2004.
The woman told authorities she has no memory of the incident and she did not voluntarily take any substance that would have rendered her to a state of physical or mental impairment.
“Any substance administered would have been without her knowledge or consent against her will,” according to court documents.
Myers is charged with one count of forcible rape, which carries a maximum penalty of life in prison if convicted.
The charge also carries a minimum sentence of five years in prison without the opportunity for a suspended sentence.
He has been assigned to Stone County Court Division I and is scheduled for arraignment Jan. 8.
He is currently being held in the Stone County Jail. His bond is set at $100,000.
