The alleged victim then retreated toward his vehicle in an attempt to find safety, while Weatherly fired one more shot that missed. Weatherly then returned to his office up the street, according to the statement.

First degree assault is a class A felony when the accused inflicts serious physical injury. Class A felonies carry a maximum sentence of life in prison.

Armed criminal action is an unclassified felony, and as a first offense, carries a minimum penalty of three years in prison without parole eligibility for three years.

He is currently being held in the Taney County Jail, with a bond set at $100,000 cash or surety. He is scheduled to return to court Dec. 4.
