Landowner, banks argue over racetrack land

Trial court date set for February

The developer of a proposed racetrack and two banks remain in a battle to determine the priority of liens on 550 acres of land in southern Taney County.

A cross-claim filed against Empire Bank by developer Russell Cook in U.S. Bankruptcy Court in the Western District of Missouri last month seeks to “assert a preference avoidance for the transfer and assignment of two promissory notes having a value of approximately ($1.13 million) on account of an antecedent debt owed to Empire.”
